Terms of Sale

ARTICLE 1 – Purpose

These General Terms of Sale (GTS) define the conditions under which WHATALEAD provides the Formlyy SaaS to customers. The service allows website owners to integrate a WhatsApp button to collect prospect data, trigger an AI-led conversation, qualify leads and schedule appointments.

ARTICLE 2 – Pricing & subscriptions

The service is offered as monthly or annual subscriptions, with prices displayed on formlyy.com. Additional features (“add-ons”) may be billed separately.

All prices are expressed in euros excluding VAT. WHATALEAD reserves the right to update its pricing at any time, but existing subscriptions remain billed at the original rate unless renewed.

ARTICLE 3 – Service Access

Access to the Formlyy service is granted after subscribing to a paid plan or after validation of a commercial offer by the Provider. No free trial, beta access without credit card, or automatic free period is included in these GTS unless specifically agreed in writing with the sales team.

ARTICLE 4 – Orders & Renewal

Subscriptions are monthly or yearly and renew automatically. The customer may cancel at any time from the dashboard. Cancellation takes effect at the end of the current billing period.

ARTICLE 5 – Payment Terms

Payments are processed by credit card through a secure provider (e.g. Stripe). Payment is due in full at the beginning of each billing period.

ARTICLE 6 – Refund Policy

The customer may request a full refund within 7 days after the first invoice. After this period, no refunds will be issued unless required by law.

ARTICLE 7 – Liability

WHATALEAD is not liable for:

• Misuse of the service,
• External outages (WhatsApp, hosting, networks),
• Lead qualification errors related to AI limitations,
• Force majeure.

ARTICLE 8 – Personal Data

Personal data is processed according to GDPR and our Privacy Policy. The customer is solely responsible for collecting prior consent from prospects before using WhatsApp.

ARTICLE 9 – Intellectual Property

All software, interfaces, logos, code and graphic assets remain the exclusive property of WHATALEAD. Any unauthorized reproduction or use is forbidden.

ARTICLE 10 – Governing Law

These GTS are governed by French and EU law. In the event of a dispute, jurisdiction lies with the courts of the provider’s registered office.

ARTICLE 11 – Changes to the GTS

WHATALEAD may update these terms at any time. Changes apply immediately to new customers and after notification to existing customers.
